OWLY — Terms of Service

These terms are a practical template. Have a qualified lawyer adapt them for the jurisdictions you operate in before public launch.

1. Acceptance

By creating an account or using OWLY you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

2. What OWLY is — and is not

OWLY is a wellness companion. It is not:

• a medical device or diagnostic tool,
• a substitute for licensed therapy, psychiatric care, or emergency services,
• a channel for emergencies — use local emergency numbers.

3. Eligibility

You must be 13 or older. Users 13–17 need a parent or guardian's awareness.

4. Your account

• One person per account; account sharing is not allowed.
• Keep your credentials safe; you are responsible for activity under your account.
• We may suspend accounts that we reasonably believe are being used to harm other users.

5. Acceptable use

You agree not to:

• Harass, threaten, or target other users.
• Share content that incites self-harm or suicide of another person.
• Upload illegal, infringing, or malicious content.
• Scrape, reverse-engineer, or automate against the service.
• Use OWLY to provide clinical services to third parties.

Crisis flags are reviewed by trained moderators; violations may result in account suspension.

6. User content

You own your journal, mood, and message content. You grant OWLY a non-exclusive, worldwide, royalty-free licence solely to store, transmit, and display that content to you and the recipients you choose. We will never use it to train third-party AI models or sell it.

7. Premium subscription

• Price: see in-app pricing (currency + interval shown before checkout).
• Billing: monthly or annual, via Stripe.
• Cancellation: any time from Profile → Subscription. You keep premium until the period end.
• Refunds: per Apple / Google / jurisdiction rules.

8. Peer support disclaimer

OWLY peers — human volunteers and AI companions — are not licensed clinicians. Conversations are moderated for safety but are not clinical care. If you need a therapist, OWLY surfaces local directory links in Discover → Therapists.

9. Limitation of liability

To the maximum extent permitted by law, OWLY, its affiliates, and its suppliers are not liable for:

• indirect, incidental, or consequential damages,
• loss of data or profits,
• the content of conversations with peers or AI,
• acts or omissions of third-party services (Stripe, SendGrid, OpenAI, Apple, Google).

Our total liability for any claim is capped at the amount you paid us in the 12 months before the claim, or USD 100, whichever is greater.

10. Intellectual property

OWLY, the owl mascot "Sage", and all app assets are ours. You may not copy or resell them.

11. Termination

You may delete your account any time. We may suspend or terminate accounts for material breach of these Terms. Certain provisions (liability, indemnity, governing law) survive termination.

12. Governing law + jurisdiction

These Terms are governed by the laws of [Your company's country / state], with exclusive jurisdiction in those courts, except where overriding consumer-protection law in your country applies.

13. Changes

We will give registered users at least 30 days' notice of any material change. Continued use after the effective date constitutes acceptance.
